1) Privacy Policy Lionfire Solutions, Inc ("Lionfire") will maintain your name, email address, billing address, shipping address, telephone number, product selections, credit card and/or other payment information, order numbers, login and password information, and any other information that you may enter into our website. All information is kept private; Lionfire will not sell, trade or rent any customer information to others. We may release account information at our discretion if necessary, such as in situations where we need to enforce and protect the rights, property and safety of Lionfire, our users, or others. We may also disclose your information to law enforcement or judicial authorities upon receipt of a court order, subpoena, or to cooperate with a law enforcement investigation. We reserve the right to report to law enforcement agencies any activities that we may deem, in good faith, to be unlawful.
2) Online Purchasing Lionfire accepts Visa, Master Card, Discover, American Express, Paypal, Money Order, Certified Check, Check, Net Terms or Wire Transfer only (pending credit department approval). We reserve the right to refuse service to anyone, including customers who provide incomplete, inaccurate, or false credit information, upon suspicion of credit card fraud or in any situation where we see fit in order to protect the rights and interest of Lionfire.
3) Title of Goods Title to all goods, products, merchandise and items specified on any invoice is retained by Lionfire until all goods are fully paid for and all other obligations have been met.
4) Returns for Refund
a) Custom Servers Lionfire builds each server to your specifications. Since Lionfire is a customized hardware supplier, there will be no refunds given for any reason on customized equipment.
b) Computer Components Lionfire will allow the refund of select computer components NOT marked or mentioned as "SPECIAL ORDER". All refunds will require an RMA number within 30 days of the original purchase date and returned merchandise must be received within 30 days of issuance of RMA number. Returned items will be subject to a 15% restocking fee. All items approved for return/refund MUST be returned in the original boxes and packing material, including ALL accessories. We reserve the right to refuse a return at anytime.
5) Warranty and Defective Components Lionfire honors a 1 year in-house parts and labor warranty for all systems configured by Lionfire. All computer components are subject to their respective manufacturers' warranty. Additionally, Lionfire will warrant all computer components for a period of one year from purchase date. For warranty repair, please contact Lionfire to obtain a Return Merchandise Authorization (RMA) number. You have 30 days to return defective items from the date the RMA number is issued. Lionfire offers the following RMA methods for your convenience:
a) Advanced Cross Shipments Replacement components will be shipped via FedEx 2 day or FedEx overnight to you for an additional fee (see below). Whole systems do not qualify for advanced replacement at this time. This includes any bare bone kit not covered by manufacturer cross ship warranty. You must supply a valid credit card number for advanced replacement service. Lionfire will place a hold on the credit card for the retail amount of all parts to be replaced, plus the cross ship fee, before items are replaced. Upon receipt of the defective items, Lionfire will return the charge to your credit card, minus the cross ship fees. If defective items are not returned to Lionfire within 30 days from the date of RMA number issuance, you forfeit the return of any charges made.
b) Standard Replacement Replacement components will be shipped via FedEx ground service to you upon receipt of defective items. PLEASE NOTE: Standard replacement could take up to 30 days to complete. Lionfire has the right to refuse any RMA not properly packaged for safe transit to our facility.
c) Shipping Lionfire will supply a prepaid FedEx ground return label for all defective items to customers residing in the United States and Canada. Customers overseas will be responsible for shipping to and from our facility for all RMAs. Replacement items may be new or refurbished, at Lionfire's discretion. All replacement items assume the remaining warranty of the original product or 90 days from the date of replacement or repaid, whichever provides longer coverage for you. Any replaced items become the property of Lionfire, and the replacement item becomes your property.
6) Limited Liability Lionfire shall not be liable under any circumstances for any damages arising out of, or in any way connected with this agreement or the product including but not limited to damages, loss of use, lost data, communication costs, loss of privacy, or damages to a third party. The foregoing limitation of liability shall apply despite any claims based upon the contribution, or failure of any limited of exclusive remedy to achieve its essential purpose or otherwise. You are responsible for the proper usage of the equipment and any consequences of the usage.
7) Claims/Freight Damage or Discrepancies If a shipment appears to be damages or has a discrepancy, you should note it on the delivery receipt and have the carrier acknowledge it. Contact Lionfire within 48 hours of delivery for us to file a claim with the carrier. Should any items be damaged, Lionfire will reship replacements to you. If you arranged your own shipping, claims for damage or loss in transit must be made to the carrier by you, as the carrier and not Lionfire is responsible for such damage or loss.
8) Refused Orders You are responsible for a 15% restocking fee on all refused orders, in addition to all freight charges. No future orders will be shipped until these fees are paid.
9) Returned Checks/Past Due Accounts If any check, negotiable instrument, or credit line of yours is returned or rejected for any reason, a $25.00 service charge will be imposed by Lionfire for each such event. An account will be deemed past due if Lionfire does not receive payment in accordance with the terms specified on the invoice. Past due accounts require payment in the form of wire transfer, cashiers check, money order, PayPal or credit card. All shipments will be withheld until the account is brought current. An interest charge of 1.5% per month (18% per annum or the maximum rate allowed by law, whichever is lower) will be imposed by Lionfire as to all sums no paid when due. In the event of legal action by Lionfire to collect any sum due on your account or enforce any term or condition of the invoice, you also agree to pay all of Lionfire's expenses of collection, including court costs and attorney's fees.
10) Choice of Law, Forum, Selection and Venue All transactions have been entered into in the State of North Carolina. The laws of the State of North Carolina shall govern all matters to the interpretation, performance and enforcement of all invoices. In the event of any litigation between you and Lionfire in connection with any invoice or good specified herein, jurisdiction shall be exclusively in the courts of the State of North Carolina, State and Federal venue shall be exclusively in the Circuit Court of Johnston County, North Carolina, or in the United States District Court for the Middle District of North Carolina in Raleigh, North Carolina.
11) No Representations You acknowledge that neither Lionfire, nor anyone acting on or behalf, has made any representation or statement of fact or opinion to induce the purchase of any goods specified on your invoice.
12) Separability If any provision of this agreement shall be unlawful, void, or for any reason unenforceable, it shall be deemed separable from the remaining provisions of this agreement, which shall remain valid and enforceable according to its terms.
13) Headings The headings and captions to each provision held within are for reference only and are not meant as a complete description of the terms held within nor shall they affect the meaning or interpretation of this agreement.
14) Entire Agreement This agreement and customer invoices are intended to be the entire agreement between you and Lionfire. These agreements will supersede all prior and contemporaneous communications, negotiations, representations and agreements between you and Lionfire, whether oral or written, with respect to the goods specified on your invoice as well as the terms and conditions hereof. Any modification to either this agreement or to any invoice must be made in writing and must also be signed by duly authorized representatives of both Lionfire and yourself.
